These terms and conditions (“Terms and Conditions”) are limited to Care Abroad and constitute an agreement between you and RMed (Pty) Ltd (“RecoMed,” “we,” or “us”), the operator of RecoMed.co.za (the “Site”). Should you use any of the other services we provide then our Standard Terms and Conditions will apply.
RecoMed is acting as a lead generator and our role is limited to passing on your personal information to our partner company [ACS], after which our involvement will cease. Any agreements you may enter into subsequently will not involve RecoMed and we will not be responsible for any aspect thereof. By providing your personal details to us via the Site or otherwise:
> you authorise us to pass on your personal information to ACS and for ACS to contact you; and
> you signify that you agree to these Care Abroad Terms and Conditions and our privacy policy.
1. We do not provide medical advice
Any information that you obtain or receive from or via RecoMed, whether on the Site or otherwise, is for informational and/or scheduling purposes only and does not create a medical professional/patient relationship, and does not constitute an opinion, medical advice, or diagnosis or treatment of any particular condition.
2.We do not carry out background checks or endorse any Providers
RecoMed does not recommend or endorse any hospitals, doctors, dentists or other health care providers (“Providers”) and we do not make any representations or warranties with respect to Providers or the quality of the healthcare services they may provide. We do not imply that any Provider is appropriate or effective for any particular individual or condition. We do not carry out background checks on any Provider. You are strongly advised to perform your own investigation prior to selecting a Provider by making confirming telephone calls to the appropriate licensing authorities to verify listed credentials and education.
3.We do not guarantee you will be seen by a Provider
We have no control over, and cannot guarantee the availability of any Provider at any particular time. We will not be liable for cancelled or otherwise unfulfilled appointments or any injury resulting therefrom.
4. Disclaimer
RecoMed is acting as a lead generator and our role is limited to passing on your personal information to our partner company [ACS], after which our involvement will cease. Any agreements you may enter into subsequently will not involve RecoMed and we will not be responsible for any aspect thereof. To the maximum extent permitted by the law we will not be liable to you or to any third party claiming under or through you for any damages and/or injury whatsoever resulting from any actions or inactions by us. Without prejudice to the generality of the aforegoing, you agree not to attempt to hold RecoMed liable for any damages and/or injury arising from any medical procedures you may undergo abroad.
5. Indemnification
YOU AGREE TO INDEMNIFY US, OUR EMPLOYEES AND PROVIDERS FROM ALL LIABILITIES, CLAIMS, DEMANDS AND EXPENSES, INCLUDING ATTORNEYS’ FEES ON AN ATTORNEY AND OWN CLIENT BASIS THAT ARISE FROM OR ARE RELATED TO YOUR VIOLATION OF THESE TERMS AND CONDITIONS. THIS CLAUSE WILL SURVIVE THE TERMINATION OF THIS AGREEMENT.
6. Entire agreement
These Terms and Conditions and our Privacy Policy constitute the entire agreement between you and us and supersede all previous written or oral agreements. If any part of these Terms and Conditions is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect. The failure of RecoMed to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.
7. Choice of law
These Terms and Conditions shall be deemed to have been entered into and shall be construed and enforced in accordance with the laws of the Republic of South Africa.
8. Assignment
We may assign this contract at any time. You may not assign, transfer or sublicense this agreement to anyone else and any attempt to do so in violation of this section shall be null and void.
